1. Acceptance of Terms
By accessing or using this Website (“Website”), including deepcharts.com and deepcharts.io, you agree to these Terms and Conditions. If you do not agree, discontinue use immediately. ACFV Tech Solutions FZ-LLC may update these Terms at any time without notice. Updates become effective upon posting

2. Eligibility and Professional-User Requirement
Users must be at least 18 years old or meet the legal age required in their jurisdiction. Deepcharts is intended for professional users, meaning individuals with adequate experience, technical competence, and understanding of financial-market analysis tools

3. Website Use and Account Responsibilities
Certain areas require account creation. Users must provide accurate information and safeguard their credentials. Prohibited activities include unlawful behavior, scraping or harvesting data, unauthorized access, bypassing restrictions, uploading harmful code, and fraudulent conduct

4. Commercial Structure and Merchants of Record
ACFV Tech Solutions FZ-LLC is the official commercial operator of Deepcharts. 

ACFV acts solely in the capacity of an international marketing agent and distributor of the Deepcharts software and related digital products.

ACFV does not develop, own, operate, or control the underlying software, systems, or technological infrastructure. All software, website functionality, algorithms, and technological components are exclusively developed, owned, and maintained by Volumetrica Trading S.R.L., which acts as the  Technology provider.

Payments are processed exclusively through designated Merchants of Record, including but not limited to Paddle and Whop. Such entities are solely responsible for billing, invoicing, tax calculation, payment processing, refunds, chargebacks, and the handling of any transaction related disputes.

5. Educational Disclaimer
All Website content is for educational purposes only. ACFV does not provide financial, trading, investment, or tax advice. Users must make independent decisions. ACFV is not liable for any financial losses or damages resulting from use of Website content

6. Intellectual Property
ACFV owns all Website content including branding, text, images, layout, documentation, and marketing materials. The software commercialized under the “Deepcharts” name is developed and owned in source code by Volumetrica Trading S.R.L., which retains full intellectual property rights. Unauthorized copying, reverse engineering, redistribution, or modification is prohibited.

7. User-Generated Content
Users may submit comments or feedback. All submitted content must be lawful, appropriate, and non-infringing. ACFV may remove content at its discretion

​8. Privacy & Data Protection
Use of the Website implies acceptance of our Privacy Policy. Deepcharts uses its own secure user area for course access, content distribution, and support workflows.

User data may be shared between ACFV Tech Solutions FZ-LLC and Volumetrica Trading S.R.L strictly to the extent necessary for the operation of the Website, including: activation and management of user licenses; provision and maintenance of software functionality; technical support, troubleshooting, and system performance monitoring; operational communications related to the Services; coordinated marketing activities, where applicable.

Such data sharing shall be limited to the minimum data required and strictly confined to the above purposes.

ACFV Tech Solutions FZ-LLC and Volumetrica Trading S.R.L operate as independent entities.

Nothing in this arrangement shall be construed as creating a partnership, joint A C F V TECH SOLUTIONS FZ - LLC- venture, or joint controllership.

Each entity remains solely responsible for its respective compliance obligations.

Personal data is processed on the basis of contractual necessity, legitimate interest, and user consent where required.

9. Digital Products, Course Access & Licensing
Digital products and educational content are accessible exclusively through the Deepcharts user area. Unauthorized sharing, copying, or resale is prohibited.

Use of the Deepcharts and Deepdom software is governed by the additional  End-User License Agreement (EULA) 9.1

9.1 End-User License Agreement (EULA)

The Company grants the User a limited, non-exclusive, non-transferable, and revocable license to access and use the Deepcharts software solely for personal and internal use.

The User shall not: copy, modify, distribute, sublicense, or commercially exploit the software; reverse engineer, decompile, or attempt to extract source code; use the software for unlawful or unauthorized purposes.

All rights not expressly granted remain reserved by Volumetrica Trading S.R.L as the technology owner.

Access to the software may be suspended or terminated in the event of breach of these Terms. The Company and/or the Technology Provider reserve the right to pursue any and all legal remedies available under applicable law, including injunctive relief and claims for damages, in connection with such breach.

10. Refund Policy
Refunds are issued by Paddle or Whop in accordance with their respective Merchant of Record policies.

Refunds may be considered within fourteen (14) days only if the user has accessed introductory or minimal content exclusively.

Accessing advanced materials, live sessions, downloadable resources, or member-only content may void automatic refund eligibility and place the request under manual review.

Verified technicals or billing issues may qualify for review from the Customer Support department.

10.1 Live Session Access – Automatic Refund Ineligibility

If the client attends, views, or accesses any live session, whether live or via replay, the purchase may become immediately non-refundable due to the material consumption of high-value proprietary content.

Live sessions are considered advanced, non-introductory components of the service, and access to such content may void automatic refund eligibility and place any request under manual review.

This policy may apply regardless of:

• session duration (partial or full attendance)

• reason for dissatisfaction

• subsequent technical, personal, or stylistic objections.

Notwithstanding the above, the Company reserves the right to review exceptional cases individually and, at its sole discretion, evaluate potential accommodations where justified by verified technical failure, billing error, or other objectively demonstrable circumstances.

Platform activity, including live session access, replay viewing, member-area usage, and related engagement metrics, may be internally tracked and verified for compliance and refund assessment purposes.

10.2 Platform Usage Beyond \Three (3) Days

If the client accesses or uses the platform for more than three (3) calendar days from the moment of first login or content access, refunds will not be issued automatically.

The three-day access period is deemed sufficient time for the client to evaluate the nature, methodology, and structure of the service. Continued access beyond this window constitutes acceptance of the product as delivered.

10.3 No Circumvention

Attempts to request refunds after: attending live sessions, or exceeding the three-day usage threshold, by re-characterizing dissatisfaction as preference, misunderstanding, or personal incompatibility will be evaluated with manual review from the dedicated team.

11. Third-Party Links
The Website may contain links to external services. ACFV is not responsible for third-party content, practices, or policies.

12. Disclaimer of Warranties
The Website is provided on an “as is” and “as available” basis, without warranties of any kind.

ACFV makes no representation regarding availability, accuracy, or reliability.

ACFV Tech Solutions FZ-LLC does not warrant or guarantee uninterrupted availability, continuous accessibility, or error-free operation of the Website, software environment, streaming infrastructure, or related technological services. Temporary interruptions, latency, maintenance events, third-party infrastructure failures, or unforeseen technical limitations may occur as part of normal digital operations.

The User expressly acknowledges and agrees that all technological infrastructure, software components, charting systems, streaming architecture, and related platform technologies are developed, supplied, maintained, and managed by Volumetrica Trading S.R.L., acting as the Technology Provider.

Any technical issue, malfunction, or platform anomaly must be reported through the designated support channels and will be reviewed in coordination with the Technology Provider where applicable.

13. Limitation of Liability
ACFV Tech Solutions FZ-LLC is not liable for indirect, incidental, or consequential damages, financial losses, data loss, system failures, or account breaches caused by user negligence. Liability is limited to the amount paid for the product or service

14. Indemnification
Users agree to indemnify and hold harmless ACFV from claims, damages, losses, liabilities, and expenses resulting from misuse of the Website or violation of these Terms

15. Dispute Resolution
These Terms are governed by the laws of the United Arab Emirates. Exclusive jurisdiction lies with the Courts of Dubai – UAE. Users are encouraged to contact ACFV for amicable resolution before pursuing legal action.

16. Force Majeure
ACFV is not responsible for delays or failures caused by events outside its reasonable control including natural disasters, cyberattacks, conflicts, or regulatory changes.

17. Service Modification & Termination
ACFV may modify, suspend, or discontinue the Website or its components at any time without notice. No compensation is owed for such modifications

18. Severability
If any provision is invalid, remaining Terms remain in effect. Invalid terms will be replaced by enforceable ones closest in meaning.
